Careless Driving vs Dangerous Driving

Dangerous driving and Careless Driving share much in common. They both involve conduct which is a departure from the standard of care one would expect from an ordinary and prudent driver. Both also carry similar penalties involving fines, license suspensions, and even jail. A conviction to either can also have a significant impact on your insurance.

The key difference between the two is the degree of severity in terms of conduct and penalties.

So how do these offences compare? Let’s take a look:

These offences are similar in that both involve a departure from the standard of care expected from a driver.

The main difference is the degree of departure from that standard of care. The greater the degree, the more likely a person may find themselves with a dangerous driving offence than a careless driving offence. 

That said, while all forms of conduct fitting dangerous driving may fall under the umbrella of careless driving, conduct that would be mere careless driving may not amount to dangerous driving. Some alleged conduct may not even be considered a departure from the standard of care expected to either offence in certain circumstances. That is why it is so important that when charged with an offence to know whether the facts alleged match the offence charged, or if there is any lawful defence available. Dangerous Driving

Every person who commits an offence under subsection 320.13(1) […] is guilty of

(a) an indictable offence and liable to imprisonment for a term of not more than 10 years; or

(b) an offence punishable on summary conviction. [fines of up to $5,000.00 and/or jail for up to 2 years]

Dangerous Operation of a Motor Vehicle is a Criminal Offence.
A conviction will result in a criminal record and show on your driving abstract which is visible to insurance companies.
Depending on how you are charged, you may find yourself with fines of up to $5,000.00 and even jail for up to 2 years for a summary offence or up to 10 years in jail for an indictable offence. The court may even suspend your licence.

On conviction […] a person is liable to a fine of not less than $400 and not more than $2,000 or to imprisonment for a term of not more than six months, or to both, and in addition his or her driver’s licence or permit may be suspended for a period of not more than two years

Careless driving is a Provincial Offence. So unlike dangerous driving, a conviction will not result in a criminal record. However, a conviction will go on your driving abstract which is visible to insurance and will carry 6 demerit points.

On a conviction, a person can see fines as high as $2000.00 and may even face jail of up to six months and license suspension of up to 2 years.

As we can see there are similar penalties involved for each offence, but the severity of those penalties are greater when charged with Dangerous Operation of a Motor Vehicle.
