Improper use of high occupancy vehicle lane – HTA 154 (1)(3)
- HOV Lane Designation: Minister may designate lanes on the King’s Highway as HOV lanes, with clear marking.
- Usage Limitations: Designation can be limited by time of year, day, or specific conditions. Only vehicles with a specified number of occupants may use these lanes.
- Regulations: Rules for using HOV lanes, including exemptions and conditions for these exemptions.
- Signs and Markings: Instructions for erecting signs and placing markings for HOV lanes and their entry/exit points.
- Construction Zones: Temporary changes to HOV lanes in construction zones are allowed, effective only when properly signed.
- Regulation Flexibility: Regulations can be general or specific, varying by vehicle type.
- Legal Requirement: Driving in HOV lanes must comply with this section and its regulations.
- Fail to Obey Lane Sign: HTA 154(1)(C)
Penalties for HOV Lane Ticket
- Fine Amount: The set fine for improper use of an HOV lane is $110 (plus court costs)
- Demerit Points: Three (3) demerit points upon conviction These penalties are for provincial highways.
- Municipal or regional roads with HOV lanes may have their own set of penalties and enforcement procedures.
- Conviction remains on driving record for 3 years
- May affect insurance rates
