Stunt Driving

Driving at a speed of 40 km/h above the limit in an area where the speed limit is less than 80 km/h, or driving at a speed of 50 km/h above the limit in an area where the speed limit is more than 100 km/h.

Stunt Driving in Ontario

Stunt driving in Ontario is a serious matter. So, if you get charged with stunt driving or racing, you need to know the law well to fight it properly.

Stunt driving in Ontario refers to really risky driving behaviors like going way over the speed limit, racing on the street, and other dangerous driving stuff. It’s really risky and can harm other people on the road. Even if it’s your first time doing it, it’s still taken really seriously by the law. It also includes using any non-approved car changes meant to make the car faster.

Stunt driving isn’t just about speeding. It also involves changes to your car that aren’t approved, like changes that make your car go faster, changes for style, or installing a stronger engine, all done to make the car perform better.

Stunt driving convictions can also increase your insurance rates significantly. Insurance companies view stunt driving as a high-risk behaviour, and they may charge you more for coverage if you are convicted of this offence. This can be a significant financial burden, and it can take years for your insurance rates to return to normal.

In Ontario, there’s a part of the Highway Traffic Act, Section 172(1), that makes it really clear: “No one can be involved in a race, contest, stunt, bet or wager while driving a car on a highway.”

To get advice that’s specifically tailored to your situation, it’s a good idea to talk to a POINTTS™ Traffic Ticket Specialist.

Penalty for Stunt Driving in Ontario

In Ontario, if you’re caught stunt driving for the first time, you can get hit with some serious penalties. Here’s what you might face:

Minimum Fine: Stunt driving can get you a fine of at least $2,000. But, depending on what happened, this could go all the way up to $10,000. Plus, there’s an extra 25% fee added for court costs.

License Suspension: Right off the bat, your license will be taken away for 30 days at the roadside. After you’ve been convicted, you might lose your license for 1 to 3 years, depending on how serious your offence was.

Vehicle Impoundment: Your car will be taken away and kept in a lot for 14 days.

Potential Jail Time: You could even end up in jail for up to 6 months.

Demerit Points: You’ll automatically get 6 demerit points added to your driving record.

Driver Improvement Course: To get your driving privileges back, you’ll have to take a mandatory course to improve your driving skills.

Keep in mind that these penalties can change and might be different depending on the details of what you did. If you’ve done this before, expect even tougher penalties, like longer license suspensions and bigger fines.

Traffic Ticket Specialist or Lawyer?

Paralegals are specially trained with a strong emphasis on dealing with traffic tickets. This means their education is more tailored and concentrated on this topic.

Having a representative with a lot of experience might be the most valuable thing for you. This includes being familiar with the prosecutor, knowing the Justices of the Peace, having worked on cases like yours before, and knowing what approaches work best to get you a good outcome. Most of the folks who have a lot of experience with traffic court in Ontario are paralegals.

In Ontario, most of the folks who have a lot of experience with traffic court are actually paralegals.

In simple terms, most companies in Ontario that help you fight a traffic ticket use paralegals, not lawyers, to represent you.

Even if a lawyer owns or runs the firm, they’ll often send a paralegal to court instead.

If you have any doubts, check the Paralegal/Lawyer Directory at the Law Society of Ontario. You should be informed about who will be standing up for you in court.

Also, it’s not unusual for lawyer offices to give their traffic ticket cases to paralegal companies. Paralegals tend to have more experience with traffic court.
