Failing to remain at the scene of an accident or report it appropriately carries severe legal consequences under both the Criminal Code and the Highway Traffic Act. Drivers must understand their obligations and seek legal guidance if facing charges related to these offenses. 

Fail To Report An Accident

Every person in charge of a motor vehicle who is directly or indirectly involved in an accident shall, if the accident results in personal injuries or in damage to property apparently exceeding an amount prescribed by regulation, report the accident.

  • Leaving the scene of an accident is illegal under both federal and provincial laws in Ontario.
  • Drivers must immediately return to the scene and provide necessary information to those involved.
  • Law mandates reporting accidents involving injuries or property damage exceeding $2,000.
  • Underestimating damage can lead to penalties, including fines and demerit points.
  • Defense is available if damage was perceived to be below $2,000 with no personal injuries.

Criminal Code – “Failure to Stop after Accident”

  •  The charge necessitates proof that the accused failed to stop, offer assistance, or provide contact information.
  • Accused individuals may be investigated based on vehicle registration information.
  • Seeking legal advice is crucial before engaging with the police.

  • Fines between $400 and $2,000, up to six months’ jail time, or both.
  • Demerit points and potential license suspension for up to two years.
